A PURCHASE OR PAYMENT WILL NOT INCREASE A PARTICIPANT’S CHANCES OF WINNING.

ELIGIBILITY

99 Ranch Market’s Customer Appreciation Sweepstakes (the “Sweepstakes”) is open only to legal residents of Northern California (limited to the following counties in California: Alameda County, Contra Costa County, El Dorado County, Marin County, Napa County, Placer County, Sacramento County, San Francisco County, San Mateo County, Santa Clara County, Solano County, Sonoma County, Yolo County) and at least 18 years of age at the time of entry. Employees (and their immediate families) of 99 Ranch Market, Welcome Market, Inc. and its affiliate and subsidiary companies (collectively referred to as “Sponsor”) are not eligible to enter or win.

TERMS

The Sweepstakes period begins on 06/07/2019 12:00AM PT and ends on 10/06/2019 11:59PM PT. All Entries must be received by 11:59PM PT on October 6th, 2019. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Odds of winning all depend on the total number of entries received. Void where prohibited or restricted by law. By entering this Sweepstakes, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations. Entrants in violation of the Official Rules will be disqualified.

HOW TO ENTER

There are two ways available for entering the Sweepstakes.

A) Scan In-Store QR Code to Enter: During the above mentioned Sweepstakes Period, QR codes for the sweepstakes will be displaying at stores of 99 Ranch Market in Northern California. Scan the QR code by using a smartphone to enter the sweepstakes webpages and fill out the entry form.

B) Alternative Method of Entry: visit 99ranch.com, click the Sweepstakes page advertisement to launch the Sweepstakes webpage and fill out the entry form.

The official online entry form must be filled out completely. Incomplete entries will be voided. Employees of 99 Ranch Market will not provide assistance to fill out/submit the entry form for any participant. All entries become the sole property of Sponsor. Sweepstakes entries that are accompanied by an order for goods or a purchase will not place the entrant at an advantage or enhance their chance of winning.

SELECTION OF WINNERS
The final drawing will be conducted publicly in October, 2019. The winning entries will be drawn randomly from all entries received. Once a winning entry is drawn, the entry will be excluded from database for any further drawings. Each participant is entitled to win one prize only. If multiple winning entries belong to any individual with the identical information provided in the entry form, including first name, last name, address and/or the last 4 digits of ID, all such subsequent entries will be disqualified. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award any prize to a person who is ineligible or has violated these Official Rules, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. Actual odds of winning depend on the number of eligible entries received during the Sweepstakes Period.

PRIZES
Please refer to the Prizes List for details. The ARV of the prize value listed is for reference only. Winners will not receive the difference between actual and approximate retail value. There is no cash substitute and prizes cannot be redeemed for cash. No more than the stated number of prizes will be awarded. Sponsor reserves the right in their absolute and sole discretion to substitute any prize of equal or greater value.

TO CLAIM PRIZES
All prize winners will be notified by Sponsor via email or by phone. The prize winners must present their valid California state driver license or resident ID, or other government issued photo ID. The information on the ID must match the information they submitted on the entry form. The prizes of the sweepstakes drawing must be claimed within the store business hours on/before 11/30/2019. Prizes not claimed by 11/30/2019 are considered as voluntarily relinquished.

The winners will be solely responsible for all taxes (federal, state, and local) and for any other fees or costs associated with the prize they receive. Sponsor reserves the right to withhold and deduct such taxes and charges from the prize if and to the extent required by law. Winners of automobiles are responsible for all associate vehicle licenses fees, sales taxes, income taxes and other costs associated with the receipt of the automobile prizes, and must register with DMV themselves. All other costs, fees, and expenses associated with the automobiles, including, but not limited to, vehicle upgrades, alternate vehicle color option, and option packages are the sole responsibility of the winner. Winners of automobiles should allow at least 45 days for car release. Winners of prizes that value more than $600 must fill out a W-9 form with their SSN information, and provide a copy of Social Security card. 99 Ranch Market is not responsible for any services, maintenances, malfunction, liabilities and responsibilities that are associated with the prizes. It is the prize winners’ sole responsibility to contact the original manufacturer or prize sponsors themselves for any services, maintenances, malfunction, liabilities and responsibilities that are associated with the prizes.

No prize substitutes are allowed except by the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize (or any part of the prize) with a prize of equal or greater value. Any difference between stated approximate retail value and the actual value of Sweepstakes prize will not be awarded. By entering the Sweepstakes, the winner agrees to accept the whole prize. If the winner cannot accept the whole prize, the winner must forfeit the prize and another winner will be chosen.

The Travel Voucher may be subject to availability, seasonality, traveling period, blackout period, maximum stay, and other possible restrictions. The Travel Voucher Prize winners must redeem the Travel Voucher within the Notification date described in the voucher. The Travel Vouchers are transferable only with verification from the Travel Voucher sponsors. The Travel Voucher Prize cannot be combined with any other discount offer. No refund or compensation will be made in the event of the cancellation or delay of any flight or travel. Not Redeemable for cash. No cash/credit back upon balance. Travel is subject to the terms and conditions set forth by the Travel Voucher Sponsor's airline carrier and/or house boat of choice as detailed in the passenger ticket contract. The Travel Voucher Prize winners should contact The Travel Voucher sponsors for more details regarding prize redemption.

The winner will be required to complete, execute and return an Affidavit of Eligibility and Liability/Publicity Release at the time of receiving the prizes, except where prohibited by law, and any other additional documents required by Sponsor. Each guest (or his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to complete, execute and return an Affidavit of Eligibility and Liability/Publicity Release, except where prohibited by law, and any other additional documents required by Sponsor within seven (7) days after receipt by such winner.

RELEASE/WAIVER
By participating in the Sweepstakes, entrants agree, and by accepting prizes, winners agree to release and hold harmless the Sponsor, its officers, directors, employees, agents, and representatives, and its Sweepstakes sponsors (collectively referred to as “Released Parties”), from any and all liability, injury, death, loss or damage, arising in whole or in part, directly or indirectly, incurred by participation in the Sweepstakes and/or the awarding, receipt, acceptance, possession or use/misuse of the prize, prize-related travel, and the winners grant to the Sponsor or their designees the perpetual right, where lawful, to use their name, address (city and state), photos, likeness, voice, biographical information, opinions, statements, facts of their winnings and/or other related information for promotion, trade, commercial, advertising, marketing, and publicity purposes at any time or times, in all media now known or hereafter discovered, nationwide or worldwide, including but not limited to the Internet, without notice, review or approval and without payment or compensation except where prohibited by law.

PRIVACY POLICY
Any personally uniquely identifiable information collected during participation in the Sweepstakes will be collected by the Sponsor. By entering the Sweepstakes, entrants agree to Sponsor’s use of entrants’ personal information in accordance with Sponsor’s Privacy Policy: https://www.99ranch.com/privacy-policy Entrants hereby acknowledge that their personal information collected by Sponsor will be used for administering the Sweepstakes and awarding the prizes, and to receive additional marketing materials and promotional messages from Sponsor unless entrants opt-out to receive additional marketing materials and promotional messages from Sponsor by emailing the Sponsor at newcustomerservice@tawa.com.

GENERAL CONDITIONS
By participating, entrants agree to comply with and be bound by these Official Rules. Sponsor shall have the sole right to disqualify any entrant from the Sweepstakes for violation of these Official Rules or any applicable laws relating to the Sweepstakes. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process, content or the operation of the Sweepstakes; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty, and (iii) are not liable for any injury, death, losses or damages arising out of any person’s participation in the Sweepstakes or the acceptance and use of any prize and travel thereto or therefrom. All disputes will be resolved under applicable California laws.

GOVERNING LAW/DISPUTES
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Orange County, California in any action to enforce (or otherwise relating to) these Official Rules or relating to this Sweepstakes.

BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED TWO HUNDRED FIFTY DOLLARS ($250.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

SEVERABILITY
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

MODIFICATION
Sponsor reserves the right to change or modify the rules and terms without further notification. Sponsor reserves the right, at its sole discretion, to cancel, modify, postpone, delay, suspend and/or terminate the Sweepstakes in whole or in part.

WINNERS’ LIST
The winners’ list will be posted in all participating 99 Ranch Market stores of Northern California and on the 99 Ranch Market website (www.99ranch.com). To obtain the winners’ list, please email us at newcustomerservice@tawa.com after 11/10/2019.
